PRIVACY POLICY

Nigrin GmbH & Co. KG (hereinafter "Nigrin", "we", or "us") respects and protects your right to data protection and privacy. This privacy policy describes

  • the data we collect through our websites (public and restricted areas).
  • data you provide to us as a customer or partner.
  • data about our customers' purchases.
  • the rights you have regarding your personal data and how you can exercise these rights.

"Personal data" is data that makes you personally identifiable, directly or indirectly — for example, your name, email address, and purchased items (to the extent we can associate them with your email address or customer account).

WHEN WE COLLECT PERSONAL DATA

We receive personal data from you or about you depending on your activities, in particular in the following cases:

Via our website:

Callback request: We store your name and phone number when you ask us to call you back.

Contact: When you ask us to get in touch with you, we store your company, title, last and first name, phone number, email address, address, and postal code so that we can provide competent advice through one of our local sales offices.

Newsletter: As a customer, you can subscribe to our newsletter. For this, we store your email address and customer number.

Visits to our website / email correspondence:
We store data about your visits to our website (pages viewed, browser information, your IP address) as well as interactive email correspondence between Nigrin and you. For more information, please see the Cookies section.

You can withdraw your consent to the use of your personal data for data analysis by Nigrin at any time. To do so, please send an email to datenschutz@wm.de. Upon withdrawal, Nigrin will no longer communicate with you through the affected channel.

Exchanges via social media:
When exchanging information on social media, the contact data exchanged and other content are processed differently depending on the provider and may also be transferred to non-secure third countries. The relevant consents are generally obtained by the provider itself.

Job postings: We post job openings on our website. After we receive your application for a position with us, you will receive an acknowledgment of receipt. If you are hired, your application documents will be filed in your employee record. If your application is unsuccessful, we retain your application documents for a further 6 months due to statutory requirements before deleting them from our systems.

Via third-party websites:

Job postings: We post job openings via specialized portals. Your applications to our job postings are forwarded to us by the portal operators. In these cases, the portal operators are responsible for compliance with data protection regulations regarding the collection and transmission to us. After we receive your application for a position with us, you will receive an acknowledgment of receipt. If you are hired, your application documents will be filed in your employee record. If your application is unsuccessful, we retain your application documents for a further 6 months due to statutory requirements before deleting them from our systems.

Via purchases:

Transactions:
From customers, we collect data on creditworthiness and purchases (online, in sales offices, by phone, etc.). In addition, we collect data from communications with you in the case of returns, exchanges, or submissions of products in connection with warranty claims or repair services.

Granting of discounts:
Cash sales for which we grant discounts are subject to special legal regulations. In these cases, the identity of the buyer must be established beyond doubt. Therefore, for these purchases, we collect your ID card data once and have it verified by additional employees. After verification — and no later than 4 weeks later — the ID data is deleted again.

Via marketing campaigns:

Participation in prize draws, contests, or promotions:
We store your company, name, and contact data when you participate in prize draws, contests, or promotions organized by us.
Partner events and trade shows:
When you attend our partner events or trade shows, we store at least your company and the first and last name of the visitor(s). Where required, we also store ID card numbers and dates of birth (e.g., for travel abroad).

HOW WE USE PERSONAL DATA

Transactions / provision of services:

Transactions:
We use your personal data to process your purchases, send confirmations, check transactions for fraudulent activity, process returns, handle repairs and exchanges of products, respond to customer inquiries, and for all related communications.

Legal requirements:
Legal requirements — for example, from copyright law, tax law, employment law, the Equal Treatment Act, or criminal law — sometimes prescribe different retention periods for certain personal data. We use your personal data to comply with these requirements.

Website administration:
We use your personal data to send the newsletter or to offer promotions.

Prize draws or contests:
If you decide to participate in a prize draw, contest, or competition organized by us, we process your personal data to allow you to participate.

Securing our assets:
We may use personal data for measures to ensure the security and integrity of our websites and our business.

We may collect and use personal data in connection with all of the purposes listed above.

Data analysis:
With your consent, we may store data about your visits to our website — including pages visited and services used — as well as data on your electronic interaction with emails sent by us as "usage data". This data is not stored under your name but anonymized using an ID number. We use such usage data to gain insights into our users' shopping preferences, to tailor our offerings and websites to your interests and preferences, to troubleshoot and optimize websites, products, and services, to analyze trends and statistics, and to present our content in the most appealing and user-friendly form for you.

USE OF PERSONAL DATA FOR MARKETING PURPOSES:

We may use personal data for marketing and market research purposes — in order to gain insights about our customers and users — as well as for direct marketing. Any marketing contact with you is always made in accordance with applicable legal provisions. In detail, this means:

We may send you postal mail, provided you have not expressly objected to receiving it.

We may send you emails with information about products that are comparable to products you have already purchased, provided you have not objected to receiving such emails.

Any further contact for direct marketing purposes (e.g., additional emails, SMS messages) takes place only with your express consent. When we send you marketing materials, we only advertise our own products.

We publish information about events (e.g., trade shows, customer events, etc.) on various platforms. These may be image galleries online, trade show homepages for the press, or YouTube posts. You may object to the use of your data and photos on-site with the event organizer (e.g., at the customer information service). Notices regarding the right to object are also posted at the respective event venues.

COOKIES AND OTHER TECHNOLOGIES

We use cookies and other technologies such as pixel tags. Cookies allow us, for example, to tailor a website to your interests or to save your password so you don't have to re-enter it each time.

DISCLOSURE AND SHARING OF PERSONAL DATA

We may disclose your data to other companies or share it with other companies in order to fulfill the tasks and purposes set out in this policy. These companies may be part of the parent group WM SE or external third parties, which may also be located outside your country of residence. These third parties provide various services such as processing payments through different channels or carrying out our marketing campaigns and trade show appearances. To provide such services, it is necessary for us to share your personal data with the participating companies.

For example, to prepare for trade show appearances, it is necessary to share company names and contact data of exhibitors with the trade show organizer and coordinators. Other examples of such services include credit checks as well as support and maintenance of our IT infrastructure.

Where we engage external service providers that work with personal data on our behalf, we take appropriate and reasonable measures to contractually ensure that your personal data is only used for the purposes specified by us.

We may share your personal data where this is necessary to comply with legal provisions, requirements imposed by authorities (including requirements relating to national security or law enforcement), to legally protect and defend our company — including our subsidiaries as well as our executives, employees, legal advisors, representatives, contractors, and partners — to pursue legal action or proceedings and to assert legal claims, or to ensure the enforcement of our terms of use and sale and the contracts we have entered into.

We may share your personal data with third parties if our assets are transferred in whole or in part to third parties. The prerequisite for this is that these third parties have privacy policies comparable to those set out in this document, and that you have given your consent to this step where required. On certain websites, we enable you to share personal data with third parties — for example, with partner companies and workshops. Where you use such features, you agree to the data transfer. The third parties' privacy policies apply to the transferred data. We have no influence over how such third parties use your personal data and assume no responsibility for the use of data by third parties. We may share aggregated, non-personal data about website users without restriction.

RETENTION PERIODS

The retention periods for your personal data are based on the applicable legal provisions as well as the retention period required to fulfill the tasks and purposes set out in this document.

Once the statutory or required retention period has expired, your personal data will be deleted. We cannot delete your personal data if there is a statutory retention obligation (e.g., accounting regulations) or if other legal grounds preclude deletion, such as contractual obligations.

SECURITY

The security of your personal data is important to us. We are aware that no data protection or security standards or measures can guarantee one-hundred-percent security. However, we take every possible step to ensure the security of the data you transmit to us in accordance with the provisions of this policy. We take various precautions to protect data against loss, misuse, unauthorized access, and unauthorized recording, use, disclosure, copying, modification, alteration, destruction, and comparable risks.

LINKS TO OTHER WEBSITES

Whenever we provide links on our website to other websites, this is done in the interest of our users or as a courtesy to the third-party provider. Sites we link to, and sites that link to our website, are not generally under our control. In such cases, we are responsible neither for the content of these sites nor for compliance with the applicable data protection regulations. We recommend that you carefully read the privacy notices of these third-party providers to learn how your personal data is stored, used, or shared.

OBJECTION AND WITHDRAWAL

With regard to the personal data you have provided to us or that has been collected as part of this privacy policy, you can opt out of the use of your personal data for direct marketing purposes relating to our products and promotions. You can contact us at any time about the various opt-out options — see also "Contact". The right to object does not apply to any communication that does not serve marketing purposes. The right to withdraw a previously given consent (e.g., newsletter) exists at any time.

REACH MEASUREMENT WITH UMAMI ANALYTICS (on-premise)

For the statistical analysis of the use of our website and to tailor our offering to demand, we use the open-source software Umami Analytics. Umami is hosted exclusively on a server operated by us under the subdomain a.nigrin.com. As our hosting service provider, we use Hetzner Online GmbH (Industriestr. 25, 91710 Gunzenhausen) with the server located in Germany. A data processing agreement pursuant to Art. 28 GDPR is in place with Hetzner.

A transfer of the collected data to third parties — in particular to providers outside the EU — does not take place. The data remains entirely within our infrastructure.

Data collected: Each time one of our websites is accessed, the following information is collected and stored in pseudonymized form:

  • page visited (URL)
  • referrer URL
  • date and time of access
  • browser, operating system, and device type used (desktop / mobile / tablet)
  • approximate geographic origin at country and city level (derived from the IP address)
  • screen resolution and browser language setting

The IP address is used exclusively to derive the approximate geographic region and is hashed and discarded immediately afterwards. The full IP address is not stored. Umami uses no cookies and does not use any other tracking technologies to recognize devices across multiple sessions.

Purpose of processing: The statistical analysis serves exclusively to optimize our website, detect technical issues, and understand which content is relevant to our visitors.

Legal basis: The legal basis for this processing is Art. 6(1)(f) GDPR (legitimate interest). Our legitimate interest lies in providing our website economically and in a user-friendly manner, and in continually improving our online offering to meet user needs. Due to the data-minimizing, cookieless design and the complete pseudonymization, our legitimate interests outweigh the protected interests of the data subjects.

Storage period: The pseudonymized usage data is stored for a maximum of 12 months and is then automatically deleted or further aggregated.

Right to object: You can object to the collection of your usage data by Umami at any time. To do so, please send an email to datenschutz@wm.de. In addition, you can prevent collection by enabling the "Do Not Track" function in your browser — this is respected by our Umami instance.

META PIXEL (FACEBOOK PIXEL)

On the basis of your consent, we use the “Meta Pixel” (also “Facebook Pixel”) on our website, a service provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Meta”). The Meta Pixel allows us to understand the behaviour of visitors after they have been redirected to our website by clicking on a Meta advertisement (Facebook/Instagram), and to deliver interest-based advertising (“Custom Audiences”) to you.

By embedding the pixel, your browser automatically establishes a direct connection to Meta’s servers. In doing so, the following data may be processed, among others:

  • the IP address of your device
  • information about your browser, operating system and device type
  • pages visited and actions triggered (e.g. page view, button click)
  • cookie and pixel identifiers (in particular the cookies _fbp and, where applicable, _fbc)
  • the referrer URL as well as the date and time of access

Purpose of processing: The Meta Pixel is used to measure the effectiveness of advertisements (conversion tracking), for retargeting and for building audiences (Custom and Lookalike Audiences) for marketing purposes.

Legal basis: The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG for storing information on, or accessing information stored on, your device. You give this consent via our consent banner and may withdraw it at any time with effect for the future.

Joint controllership: For the collection and transmission of data by the pixel, we are joint controllers with Meta within the meaning of Art. 26 GDPR. The joint controller agreement (Controller Addendum) is available at facebook.com/legal/controller_addendum. Meta is solely responsible for the subsequent processing of the data.

Transfer to third countries: As part of this use, data may be transferred to Meta Platforms Inc. in the USA. For the USA, an adequacy decision of the EU Commission exists on the basis of the EU-U.S. Data Privacy Framework, to which Meta has self-certified; in addition, Meta relies on Standard Contractual Clauses pursuant to Art. 46 GDPR.

Storage period: The data collected via the pixel is processed and stored by Meta in accordance with its data policy. Cookies set by the Meta Pixel have a storage period of up to 90 days.

Withdrawal: You can withdraw your consent at any time via the cookie settings on our website. Further information on data processing by Meta as well as on your rights and settings options can be found in Meta’s data policy at facebook.com/privacy/policy.
